Ballsagna, LLC • Last Updated: October 12, 2026
1. Acceptance of Terms & Eligibility
Welcome to Quickle, operated by Ballsagna, LLC ("Ballsagna", "we", "our", or "us"). By accessing or playing Quickle via our mobile applications (iOS and Android) or at playquickle.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
You must be at least 13 years of age (or at least 16 years of age if you reside in the European Economic Area or United Kingdom) to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms.
2. Limited License
Subject to your compliance with these Terms, Ballsagna, LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial entertainment purposes.
3. Virtual Currency ("Pickles" 🥒) & Virtual Items
Quickle includes virtual points, experience ("XP"), badges, avatars, hints, and virtual currency known as "Pickles" (🥒) (collectively, "Virtual Items") earned through gameplay and weekly leaderboard rewards.
- No Monetary Value: Virtual Items have zero real-world monetary or cash value. They are not property, cannot be purchased or sold for real money, and cannot be redeemed, cashed out, or exchanged for fiat currency, cryptocurrency, goods, or services from Ballsagna, LLC or any third party.
- Non-Transferable License: You do not own Virtual Items; instead, you are granted a limited, revocable license to use them inside the game. Ballsagna, LLC reserves the right to manage, regulate, modify, rebalance, or eliminate Virtual Items at any time, with or without notice, and with no liability to you.
4. User Accounts, User-Generated Content (UGC) & Conduct
The Service allows you to create or share limited User-Generated Content ("UGC"), including your chosen display name, avatar selection, custom 1v1 multiplayer challenge boards, gameplay scores, and post-match emoji reactions.
- License to Your UGC: You retain any ownership rights you hold in your UGC, but by submitting or displaying UGC within the Service, you grant Ballsagna, LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (e.g., for formatting or profanity filtering), and publicly display your UGC solely for operating, improving, and promoting the Service (such as displaying public leaderboards and 1v1 challenge results).
- UGC Responsibility & Moderation: You are solely responsible for your display name and any UGC you submit. Ballsagna, LLC does not endorse and is not responsible or liable for any UGC generated by users. We reserve the right—but have no obligation—to monitor, filter, rename, remove, or restrict any UGC or user account at any time, for any reason, without prior notice.
- Prohibited Conduct: When using the Service, you agree not to: (a) select a display name that is unlawful, defamatory, hateful, sexually explicit, harassing, or impersonates another person; (b) use bots, scripts, automated solvers, memory editors, or unauthorized third-party tools to manipulate scores, timers, XP, or leaderboard rankings; or (c) interfere with, scrape, or disrupt the Service, servers, or Firebase database infrastructure.
You may permanently delete your account and associated UGC at any time via Settings → Delete Account or at playquickle.com/delete-account.
5. Data Privacy & Cookie Policy
Your privacy matters to us. Our collection, use, storage, protection, and deletion of your personal information, gameplay data, cookies, and local device storage are governed by our Privacy & Cookie Policy, which is incorporated into and made part of these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy & Cookie Policy, including how to manage your analytics cookie preferences and exercise your data deletion rights.

7. Apple App Store & Google Play Store Notice
If you download Quickle from the Apple App Store or Google Play Store, you acknowledge that these Terms are concluded solely between you and Ballsagna, LLC, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Ballsagna, LLC—not Apple or Google—is solely responsible for the Service, its content, maintenance, support, and addressing any claims relating to the Service. 8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BALLSAGNA, LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT GAME PROGRESS WILL NEVER BE LOST.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BALLSAGNA, LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR VIRTUAL ITEMS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL BALLSAGNA, LLC'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO BALLSAGNA, LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).
10. Dispute Resolution, Binding Arbitration & Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
- Mandatory 30-Day Informal Dispute Resolution: Before either party may initiate any arbitration or court proceeding, the claiming party must first send a written Notice of Dispute to the other party (to Ballsagna, LLC at ross@theballsagna.com) describing the nature and basis of the claim and the specific relief sought. Both parties agree to negotiate in good faith to resolve the dispute informally for at least thirty (30) days after receipt of the Notice of Dispute before commencing any formal proceeding.
- Binding Individual Arbitration: If a dispute is not resolved within 30 days of the Notice of Dispute, you and Ballsagna, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Privacy & Cookie Policy, or the Service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (available at adr.org), rather than in court. The arbitration may be conducted telephonically, via video conference, or based on written submissions unless the arbitrator determines an in-person hearing is required. Either party may, however, bring an individual action in small claims court if the claim qualifies, or seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
- Class-Action, Mass-Arbitration & Jury Trial Waiver: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BALLSAGNA, LLC WAIVE ANY RIGHT TO A TRIAL BY JURY AND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING. Unless both you and Ballsagna, LLC agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
- 30-Day Right to Opt Out: You have the right to opt out of the binding arbitration and class-action waiver provisions above by sending written notice of your decision to opt out to ross@theballsagna.com within thirty (30) days of first accessing the Service or accepting these Terms. Your notice must include your display name, any email address associated with your account, and an explicit statement that you wish to opt out of arbitration.
- Governing Law & Venue: This arbitration agreement is governed by the Federal Arbitration Act ("FAA"). In all other respects, these Terms and any dispute arising out of or related to the Service shall be governed by the laws of the State of New York, United States of America, without regard to its conflict of law provisions. For any actions not subject to arbitration, you and Ballsagna, LLC consent to exclusive personal jurisdiction and venue in the state and federal courts located in New York.
